1. Acceptance of Terms
By accessing or using the Black Watch Auction website and participating in any auction, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
2. Auction Participation
All bids placed on Black Watch Auction are binding offers to purchase. By placing a bid, you confirm that you have the legal capacity to enter into a binding contract and that you intend to complete the purchase if you are the winning bidder. Bids cannot be retracted once submitted.
3. Item Authenticity
Black Watch Auction makes every effort to accurately describe and authenticate items listed for sale. The Shure V64 / Lectrosonic M185 wireless microphone listed on this site is authenticated via video evidence. All authenticity claims are based on documented evidence available for review. We do not guarantee the completeness of provenance documentation beyond what is presented.
4. Winning Bidder Obligations
The winning bidder is obligated to complete the purchase within 48 hours of being notified. Failure to complete payment within this window may result in forfeiture of the bid and re-listing of the item. Black Watch Auction reserves the right to pursue legal remedies for non-payment.
5. Payment
All payments must be made in full prior to shipment. Accepted payment methods are displayed at checkout. All prices are in US Dollars. Applicable taxes and shipping costs will be added at checkout.
6. Shipping and Delivery
Items will be shipped within 5 business days of confirmed payment. All items are shipped with insurance and tracking. Risk of loss transfers to the buyer upon delivery to the carrier. Black Watch Auction is not responsible for delays caused by the shipping carrier.
7. Returns and Refunds
All sales are final. Due to the unique and one-of-a-kind nature of auction items, returns are not accepted unless the item received materially differs from its description. Any disputes must be raised within 7 days of receipt of the item.
8. Prohibited Conduct
Users may not engage in bid manipulation, shill bidding, or any fraudulent activity. Violation of these rules will result in immediate disqualification and may be reported to relevant authorities.
9. Limitation of Liability
Black Watch Auction shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or participation in our auctions. Our total liability shall not exceed the amount paid for the item in dispute.
10. Governing Law
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts of California.
11. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Updated terms will be posted on this page. Continued use of our services after changes constitutes acceptance of the revised terms.
